We’ve
written about AB46 before but this bad bill is still not dead.
This bill is intended to force Nevada into compliance with
a Federal law seeking mental health records in order to deny
gun purchases.
GONV’s contention is that we should not be providing
more personal data to an administration that has openly demonstrated
animosity toward gun owners. Your representatives in Carson
City think otherwise, and they need to hear from you NOW!
GONV hears from people almost every week who have
been denied firearm purchases because government databases
indicate some "criminal" history.
Criminal histories should, at least in theory, be public record.
But the fact is that getting details about criminal histories
from other states is often an exercise in frustration.
How much worse will it be if you are mistakenly identified
as "mentally defective" and the State Police have
an even harder time getting access to records that would clear
you?
We are opposed to the Brady check system as a prior restraint
on your rights. We oppose any expansion of the system, which
AB46 would be. But as a practical matter, we are very concerned
that if enacted, AB46 would cause the many problems we have
with State Police background checks to multiply.
Waiting months to lawfully purchase a firearm while
you are in fear for your life is not the definition of a free
person.
Under this bill we expect this to happen frequently.
We
urge you to contact your Assemblymen and women, and Senators
listed here and let them know that we do not need to expand
the failed Brady background check system.

Dear Elected Official,
Although attempts have been made to improve AB46, the problems
with the bill remain.
The current "Brady background check” system often
prevents legitimate firearm purchases because of faulty criminal
history records. Adding "mental health" records
to the system will only cause more problems, especially since
by their nature, mental health records are meant to be kept
as private as possible. This will make it nearly impossible
for the State Police to clear a person falsely accused of
being a "mental defective."
This bill creates more problems than it solves. Please do
NOT send this bill to the Governor.
